1) Who we are and agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and BASIL LABS FZ-LLC (“Aurus”, “we”, “our”, or “us”), the developer and operator of the Aurus mobile application, the website at https://aur.us, and related services (together, the “Services”). By downloading, installing, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Services.

2) Non-custodial wallet
Aurus is a non-custodial wallet. You retain sole control of your private keys, recovery phrase, and digital assets at all times. We do not collect, store, or have access to your private keys or recovery phrase, and we cannot access, freeze, transfer, or recover your digital assets under any circumstances. Transactions you sign are broadcast to the Solana blockchain and generally cannot be reversed. You are solely responsible for maintaining the confidentiality and security of your keys, your recovery phrase, and the device on which you use the Services.
3) Eligibility
To use the Services you must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) and have the full right, power, and authority to enter into these Terms. You must not be located in, ordinarily resident in, or a national of any country or territory that is subject to comprehensive sanctions or embargoes, and you must not be named on any sanctions list, including lists maintained by the United Nations, the European Union, the United Kingdom, the United States (OFAC), or the United Arab Emirates. By using the Services you represent and warrant that your use is permitted under the laws of your jurisdiction and that these eligibility requirements are satisfied at all times.
4) Your wallet and security
When you create or import a wallet through Aurus, the wallet is generated and stored on your device. You are solely responsible for all activity that occurs through your wallet, for keeping your device, PIN, biometrics, and app access secure, and for verifying transaction details before signing. You must not share your credentials, private keys, or recovery phrase with anyone. We will never ask you for your recovery phrase or private keys — anyone who does is attempting to steal your assets.
5) Recovery phrase
Your recovery phrase (seed phrase) grants complete access to your wallet and every account derived from it, and can be used to restore your wallet on any compatible software. You bear absolute responsibility for safeguarding it. If you lose your recovery phrase and your device, access to your wallet and digital assets will be permanently lost. We do not store your recovery phrase and cannot restore it for you under any circumstances.
6) License and permitted use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Services for your personal, non-commercial use. Except as expressly permitted by these Terms or by applicable law, you may not copy, modify, distribute, sell, rent, or sublicense the Services or any part of them; reverse engineer, decompile, or disassemble the Services; create derivative works based on the Services; circumvent, disable, or interfere with security-related features; or use the Services to build a competing product or service.
7) Third-party services and content
The Services may display, link to, or interact with services and infrastructure operated by third parties, including decentralized exchanges and aggregators, decentralized applications (dapps), tokens and token metadata, RPC and blockchain infrastructure providers (such as Helius), and error-monitoring services (such as Sentry). Third-party services are not under our control. We do not endorse them and are not responsible for their availability, accuracy, security, legality, or fees, or for any losses arising from your use of them. Your use of third-party services is at your own risk and may be subject to their own terms and policies. Tokens shown in the app are created by third parties, and the listing or display of a token is not an endorsement of it or a representation about its value or legitimacy.
8) Fees
Using the Services may involve fees. These include network fees paid to the Solana network (such as transaction and priority fees and rent), Aurus swap fees as displayed in the app at the time of the transaction (see our fees page for current details), and fees charged by third parties such as protocols, liquidity providers, or on/off-ramp providers. Fee amounts shown before you sign are estimates, and actual amounts may vary due to network conditions, price movement, and slippage. All fees are non-refundable once a transaction is confirmed on-chain.
9) Acceptable use
You agree to use the Services only for lawful purposes. In particular, you agree not to use the Services to violate any applicable law or regulation, including sanctions and anti-money-laundering laws; to engage in fraud, market manipulation, phishing, or other deceptive practices; to launder money or finance terrorism; to infringe the rights of others, including intellectual-property rights; to impersonate any person or entity or misrepresent your affiliation; to transmit malware or interfere with the integrity or performance of the Services or the networks they rely on; or to attempt to gain unauthorized access to any systems, wallets, or data.
10) Your representations and warranties
Each time you use the Services you represent and warrant that any digital assets you use were lawfully acquired and are not the proceeds of criminal activity; that any information you provide to us is accurate and complete; that you remain in compliance with Section 3 (Eligibility); and that you are responsible for determining and paying any taxes that apply to your transactions.
11) Intellectual property and feedback
The Services, including all software, designs, logos, trademarks, text, and other content (excluding user content and third-party content), are owned by us or our licensors and are protected by intellectual-property laws. No rights are granted to you other than the limited license described in Section 6. If you send us feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without compensation or attribution.
12) App store terms
If you download the app from Google Play or the Apple App Store, you also agree to comply with the applicable store’s terms of service. The store operator is not a party to these Terms and has no obligation to provide support or maintenance for the Services.
13) Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including if we reasonably believe you have violated these Terms or where required by law. You may stop using the Services at any time. Because Aurus is non-custodial, termination does not affect your control of your keys or on-chain assets — you can always restore your wallet in other compatible software using your recovery phrase. Sections that by their nature should survive termination (including Sections 14 through 22) survive.
14) Warranty disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
15) No professional advice; no fiduciary duties
Nothing in the Services constitutes investment, financial, trading, legal, or tax advice. Information shown in the app, including prices, charts, and token data, is provided for informational purposes only. These Terms do not create any fiduciary duties owed by us to you.
16) Taxes
You are solely responsible for determining what taxes, if any, apply to your transactions, and for reporting and remitting them to the appropriate authorities. We recommend consulting a qualified tax professional.
17) Forks and airdrops
We may, at our sole discretion, decide whether or not to support any blockchain fork, airdrop, or similar event. We make no guarantees regarding your ability to access, claim, or realize value from forked or airdropped assets through the Services.
18) Risk disclosure and assumption of risk
Using cryptocurrencies and decentralized networks involves significant risk, including the risk of total loss of funds. Digital assets can be extremely volatile, transactions may be irreversible, and interacting with smart contracts or decentralized applications may expose you to bugs, exploits, phishing, and other attacks. By using the Services you acknowledge these risks and agree that you assume them entirely. You are solely responsible for your trading decisions, your security practices, and your compliance with applicable laws.
19) Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless BASIL LABS FZ-LLC and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, your violation of any law or the rights of a third party, or your digital assets and transactions.
20) Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR DIGITAL ASSETS, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED USD $100 (OR ITS LOCAL EQUIVALENT).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
21) No money transmission
Aurus is self-hosted wallet software. We do not take custody of, transmit, exchange, or process your funds or digital assets, and we are not a bank, exchange, broker, money-services business, or payment processor. You initiate and execute all transactions yourself, directly on the blockchain.
22) Governing law and dispute resolution
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Ras Al Khaimah, without regard to conflict-of-law principles. Before initiating any formal proceeding, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts of Ras Al Khaimah, United Arab Emirates. To the fullest extent permitted by law, any dispute will be resolved on an individual basis, and you waive any right to participate in a class or representative action.
23) Force majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, pandemics, war, terrorism, labor disputes, governmental actions, power or internet failures, blockchain network failures or congestion, and cyberattacks.
24) Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Services.
25) General
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior understandings. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We may provide notices via the app, the website, or email. The English version of these Terms controls any translation.
